Online Return and Exchange Policy

1. INTRODUCTION

1.1 This Online Return and Exchange Policy (“Policy”) is applicable only to online customers in Malaysia who have purchased products through the Dive In website and does not extend to customers who have purchased from other websites or retail stores.

1.2 This Policy provides online customers in Malaysia who have purchased products through the Dive In website with options to return or to exchange products.

1.3 All defined terms not otherwise defined in this Policy shall have the same meaning as that ascribed to the Terms & Conditions for Users.

2. RETURN CONDITIONS AND PROCESS

2.1 Dive In is passionate about ensuring that you are completely satisfied with your purchase. If you change your mind about the product purchased, you are entitled to return the product within 14 days of receipt should it meet the below requirements:
a) The product delivered is not what you ordered, does not correspond with its description on the website on the date of purchase or damaged
b) The product is unused, unworn, undamaged and unwashed
c) The product delivered is in their original packaging
d) The product delivered must have the original tag and bikini bottoms must have hygienic sticker
• Please make sure that swimwear is tried on over your own underwear. In the interest of hygiene, we may refuse returns of items where it’s obvious that this hasn’t been done
e) The proof of purchase is provided
f) The Returns Form is enclosed in returns package

2.2 To proceed with your return request, you must complete the Return Form within 14 days of receiving the product at your delivery address. Upon receipt of your return request, Dive In will review your return request and at Dive In’s sole discretion, decide to:
a) Exchange the product with a new item
b) Give you a full refund for the product
c) Inform you that your product is not eligible for return

2.3 Dive In will confirm your request for a return through email and upon receiving such confirmation, you may direct all return or exchange packages to:

2.4 Dive In does not accept responsibility of customer sent return or exchange packages; so it is advised that when shipping returns or exchanges that meet the above required criteria, customers should select a service that provides tracking.

2.5 Shipping cost, tax and related expenses incurred on a return and exchange is at the customer’s expense and cannot be refunded unless deemed faulty by Dive In.

2.6 Dive In must receive and approve your return request before your return can be processed.

2.7 Once your return is received and inspected your refund will be processed in the method as the original payment within 14 business days of Dive In receiving the return parcel. Notification will be sent to nominated email address at the time of this transaction. Dive In cannot be held accountable for banking institution processing timeframes.

3. EXCHANGE CONDITIONS AND PROCESS

3.1 Dive In allows for an exchange of products that meet the required criteria for another size; subject to product availability.

3.2 The exchange will be processed within 14 business days of receipt and notification of this transaction will be provided to the nominated email address.

3.3 Should a faster exchange be required, Dive In recommends sending the product back for a refund and placing a separate order online for a new item.

3.4 Should the item requested for exchange be the same value as that of the product being returned, no additional payment will be required and the exchange item will be dispatched free of charge.

4. NO OBLIGATION TO REFUND OR EXCHANGE

4.1 Dive In reserves the right not to accept any requests for a return or exchange, and retains the discretion not to provide a reason for Dive In’s decision.

4.2 Without prejudice to the foregoing, Dive In reserves the right to decline the return request, for any of the following reasons:
a) The Product(s) is not returned in satisfactory condition in its original packaging; or
b) The Product(s) has been opened, used or otherwise tampered with to the extent that it is no longer in a saleable condition.

For the avoidance of doubt, products marked or otherwise indicated as “Final Sale” or other similar expressions are not eligible for return or exchange.
